ECONOMICS OF CRIME: Retd IPS Abhayanand

उदाहरणों में शामिल हैं: - #फर्जी ज़मानत [मधेपुरा 1981 से 1982]: जब मैंने फर्जी ज़मानतों पर आधारित ज़मानत बांड रद्द करवाने शुरू किए, तो मधेपुरा में डकैतियों की संख्या शून्य हो गई। - #नक्सली अभियान [औरंगाबाद 1982 से 1983]: नक्सली अभियानों के पीछे की आर्थिक ताकत अवैध गतिविधियों से आती थी, जिनमें केंदू पत्तों की तस्करी से लेकर बेनामी ज़मीन पर खेती तक शामिल थी। इन अवैध गतिविधियों पर तुरंत रोक लगाने से इलाके में उनके आतंक को कमज़ोर करने के लिए काफ़ी था। - #आय से अधिक संपत्ति [सीबीआई 1984 से 1988] - #अपहरण [बेतिया 1992 से 1993]: गैंगस्टरों को मिलने वाली फिरौती की रकम बहुत कम थी, जो गिरोह को चलाने के खर्च को पूरा करने के लिए भी पर्याप्त नहीं थी। अपहरण आतंक पैदा करने के लिए किए जाते थे ताकि उनकी अवैध गतिविधियों से पैसा कमाया जा सके। मैंने इन गैर कानूनी गतिविधियों पर सीधे प्रहार करना शुरू कर दिया, जिससे गैंगस्टरों की योजनाएँ धराशायी हो गईं। - #खनन माफिया [एडीजी मुख्यालय 2006 से 2008] - आर्थिक अपराध इकाई [डीजीपी 2011 से 2014]: यह इकाई अपराध कम करने और काले धन पर लगाम लगाने के लिए सीधे डीजीपी को रिपोर्ट करती हुई बनाई गई थी। यह प्रवर्तन निदेशालय के लिए PMLA लागू करने हेतु प्रेरक एजेंसी बन गई। कहने की ज़रूरत नहीं कि इसने अपने गठन के उद्देश्य को पूरी तरह से सही ठहराया। - #अवैध शराब त्रासदी [डीजीपी 2011 से 2014]: इस अवधि के दौरान, राज्य में लगातार तीन अवैध शराब त्रासदी की घटनाएँ हुईं। चूँकि उस समय शराबबंदी नहीं थी, इसलिए शराब की मौजूदगी के ख़िलाफ़ कोई सीधी आपराधिक कार्रवाई नहीं हो सकती थी। मैंने इन घटनाओं को आर्थिक अपराधों में बदल दिया और इन्हें राज्य के राजस्व की हानि के रूप में पेश किया। PMLA के तहत उनकी संपत्तियाँ ज़ब्त कर ली गईं, जिससे उनके धन का स्रोत छिन गया। - #ज़मानत रद्द करना [डीजीपी 2011 से 2014]: ज़मानत रद्द करने के पीछे मुख्य उद्देश्य अपराधी को फिर से सलाखों के पीछे न डालना था बल्कि इन कार्रवाइयों ने इन अपराधियों को उनकी नौकरियाँ और उनकी आजीविका के स्रोत छीन लिए। 1989 में नालंदा में अपने कार्यकाल के दौरान, मैंने जाना कि अपराधी अपराध को अपना पेशा मानते हैं, जिससे मुझे ज़मानत रद्द होने के प्रभाव का अंदाज़ा हुआ। - #सांप्रदायिक दंगे: सच्चाई यह है कि हर दंगा, चाहे वह सांप्रदायिक हो, जातीय हो, जातिगत हो या इसी तरह का, अल्पसंख्यकों पर हमला करता है और इतना आतंक पैदा करता है कि उन्हें दंगा प्रभावित इलाकों से खदेड़ दिया जाता है, और जो लोग भाग जाते हैं, वे अपनी संपत्ति बेच देते हैं। उदाहरण हैं 1989 के भागलपुर दंगे, 2001 का ब्रिटेन में ब्रेडफोर्ड जातीय दंगे, 2013 का नवादा दंगा। - Retd. IPS अभयानंद (from Book Unbounded) ----------------------------- I am convinced that the power of criminals and the potential to commit crimes does not lie in his 'person'; instead, it lies in his assets and his properties. This desire to shift the focus of policing from person to property burned within me for a long time. I got a mere 3 years to put my ideas into practice when I became the police chief. My only silver lining was the Prevention of money laundering act 2002, unfortunately this act does not provide police with any power what so ever. The only role I could play was that of a catalyst for the enforcement directorate (ED), the agency created under the PMLA for the execution of the act. Bihar was the first state to have experimented with this idea and confiscation orders of properties of illegal wealth and laundered white assets of gangsters were passed. The idea that every crime is essentially an economic activity was cemented in my mind from the early days of my career. In my 37 year long journey, I never hesitated in taking uncharted paths trying to uncover New horizons of policing. Examples include: - #Fake sureties [Madhepura 1981 to 1982]: dacoities in Madhepura drop to Nil when I started getting bale bonds that were based on fake sureties cancelled. - #Naxal operations [Aurangabad 1982 to 1983]: the economic force behind the naxal operations came through illegal activities which included smuggling of Kendu leaves to farming on benami land. A quick check on these illegal activities were more than enough to weaken their terror in the area. - #Disproportionate assests [CBI 1984 to 1988] - #Kidnappings [Bettiah 1992 to 1993]: the ransom money, the gangsters received was peanuts, not even sufficient to sustain the establishment cost of the gang. The kidnappings were done to produce terror which would make their money spinning illegal activities easy. I started hitting at these legal activities directly which puts the plans of the gangsters in disarray. - #Mining Mafia [ADG headquarter 2006 to 2008] - #Economic Offences unit [DGP 2011 to 2014]: this unit was created directly reporting to the DGP to check black money to mitigate crime, it became the driving agency for the enforcement directorate to implement PMLA, needless to say, it completely justified the purpose for which it was created. - #Hooch tragedies [DGP 2011 to 2014]: during this period, 3 successive hooch tragedy incidents occurred in the state. Since there was no alcohol Ban at that time, there could be no direct criminal action against the presence of alcohol. I converted these incidents into economic crimes, projecting them as loss of revenue to the state. Their properties got attached under PLA, snatching away their funding source. - #Bail cancellations [DGP 2011 to 2014]: the main idea behind cancelling bail was not to put the criminal behind bars again. These action put these criminals out of their jobs, their sources of livelihood. During my Nalanda tenure in 1989, I had learnt that criminals treated crimes as their profession, which has convinced me about the impact that bail cancellations could have. - #Communal riots: the truth is that every riot whether communal, ethnic, caste or alike, attacks a minority and creates enough terror to chase them out from riot affected areas, the people who flee sell of their properties.
